1794 A case heard in september 1794 at? Thomas Webb was charged with writing a malicious letter to Grose, a rambling affair in which he suggested that Grose had allowed a convict Richard Haynes to be flogged to death . The trial is reported by Cobley in full , as he says to illustrate contempory attitudes towards degrees of punishment , especially on the part of the attending surgeons. John White the principal surgeon gave evidence , as did his assistant , to the effect that a surgeon was always present except when only some slight punishment such as 25 lashes was to be given to a strong healthy man , Webb had alleged that Haynes who had sold a pair of shoes to his wife was charged with this offence and been ordered 100 lashes , of which he recieved 30 . He was aweakly man not able to undergo the full punishment and was sent to the hospital. The surgeon alleged that he would have died of consumption in any case Thomas Webb was fined œ50 for his libel
